Terms of Use

These Terms of Use (“Terms”) govern access to and use of FivePark.co and its related community, directory, publishing, listing, and inquiry features (the “Site”). The Site is operated by a private resident acting in an individual, volunteer capacity (the “operator,” “we,” “us,” or “our”). FivePark.co is the website name, not a separate legal entity.
By affirmatively accepting these Terms when prompted, creating an account after receiving notice of them, or otherwise using the Site where these Terms have been presented as governing that use, you agree to these Terms. If you do not agree, do not create an account or use interactive services. Our Privacy Policy explains how we handle personal information; acceptance of these Terms is not consent to optional marketing or undisclosed data uses.
1. Independent and unofficial website
FivePark.co is independently operated. It is not affiliated with, sponsored by, endorsed by, operated by, or authorized to speak for the Five Park condominium association, building management, developer, or their representatives. References to the building identify the community served and do not imply an official relationship.
The Site is not an official channel for maintenance, security, building notices, association business, reservations, or emergencies. Posting here does not notify management or satisfy any notice requirement. Contact the appropriate official channel directly. For an emergency, contact emergency services; the Site is not monitored continuously.
2. Eligibility and accounts
You must be at least 18 to register, submit content, apply for verification, or use inquiry features. Provide accurate information, keep it current, protect your login credentials, and notify us if you believe your account is compromised. Do not impersonate another person, use someone else’s evidence, share a verified account, or evade an account restriction.
Businesses and agents may participate only in features available to them. Approval of a commercial account does not grant access to resident-only spaces. If you act for a business or another person, you must have authority to do so.
3. Verification and member identity
Access to restricted community features requires approval under the Site’s eligibility criteria. We use Didit, a paid third-party service, for address verification. Submit requested evidence through the designated verification flow. A verified address does not by itself establish ownership, tenancy rights, or another approved connection to the community; your membership category must accurately reflect your circumstances.
Verification must be renewed annually and may end earlier if eligibility changes. You must notify us of a move-out or other material change. We may pause restricted access while verification is incomplete, expired, disputed, or revoked. You may request review of an eligibility decision by contacting the administrator.
FivePark.co does not store documents or underlying information used by Didit to verify your address. We retain a minimal eligibility record as described in the Privacy Policy; Didit handles its verification records under its notices and configured retention rules. Full legal names and unit numbers from resident records are never shown publicly. In community spaces, members appear as first name and last initial. Do not publish full resident names or unit numbers in contributions.
Verification and membership tags do not constitute a background check, an endorsement, or a guarantee of identity, honesty, authority to sell, financial standing, or safety. Our use of a paid provider does not itself impose a fee on you. Any fee we charge must be disclosed before purchase and does not purchase approval.
4. Community standards
Use the Site to exchange useful information, build connections, and participate respectfully. Constructive questions and good-faith recommendations are welcome. The following are prohibited:
- Threats, harassment, discriminatory abuse, intimidation, stalking, or encouragement of violence.
- Political campaigning, partisan debate, and unrelated political arguments.
- Defamatory statements, knowingly false claims, targeted personal accusations, or publication of private disputes to shame or pressure someone.
- Publishing personal contact details, full resident names, unit numbers, verification documents, access codes, security procedures, or private community content without permission.
- Fraud, impersonation, illegal activity, scams, spam, undisclosed promotions, or unauthorized solicitation.
- Content that infringes intellectual property, violates confidentiality, or includes images or information you lack permission to share.
- Malware, attempts to bypass access controls, unauthorized data collection, bulk extraction of member information, or interference with the Site.
5. Moderation and account restrictions
We may review submissions before publication, request edits, move or close discussions, restrict visibility, remove content, or warn, suspend, or terminate accounts for violations, loss of eligibility, security concerns, or material misuse. Serious threats, privacy exposure, or fraud may result in immediate action.
We are not required to publish every submission or monitor every interaction. Approval of content does not mean we endorse it or have verified every statement. Where practical and lawful, we will provide a reason for significant moderation or account action. You may submit an appeal through jeremy@originalclick.com. We may preserve limited records needed to review an appeal, investigate abuse, or meet legal requirements under the Privacy Policy.
6. Your content and permission to display it
You retain ownership of content you create. You represent that you have the rights and permissions needed to submit it and that it is accurate to the best of your knowledge. You are responsible for reviewing material before publication, including drafts produced with an automated tool.
You grant us a nonexclusive, royalty-free license to host, store, format, reproduce, and display your submitted content solely to operate the Site and make it available to the audience you select or authorize. We may allow our service providers to perform those functions for us. This license does not permit us to sell your personal information, publish verification evidence, or make a private community post public without your permission.
We may make formatting changes or ask you to revise material for clarity or compliance. Promotional use of your content outside its intended Site audience requires separate permission. The license ends when content is deleted from active systems, except for restricted backups, legal retention, and copies others lawfully received while it was available. Public search caches or third-party copies may persist outside our control.
7. Classifieds and direct transactions
FivePark.co provides classified advertisements. Buyers and sellers arrange all purchases, payments, delivery, pickup, inspection, returns, and disputes directly with each other. Outside buyers may contact sellers where a listing permits it.
FivePark.co does not process payments for classified goods or property transactions, hold deposits, provide escrow, act as a party to the transaction, or guarantee a transaction. We do not inspect items, verify title, promise that descriptions are accurate, warrant that goods are safe or lawful, or provide purchase protection.
Sellers must have authority to offer their items, describe them honestly, use authorized images, state the price and relevant conditions, and update unavailable or sold listings. Buyers must independently evaluate the item, seller, payment method, and pickup arrangements. Do not rely on a membership badge as a guarantee.
Illegal goods, weapons, controlled substances, counterfeit or stolen goods, fraudulent financial offers, and personal records may not be listed. We may remove other unsuitable listings under published category rules. Listing approval does not establish legality or ownership.
Keep pickup details private and follow building access rules. A listing, inquiry, or purchase does not authorize anyone to enter the building or use its facilities. The Site may remove a listing or restrict an account in response to a report but does not adjudicate, insure, or guarantee resolution of a transaction dispute.
8. Property listings and professional services
Property listings are advertisements submitted by an authorized owner, agent, or other approved provider. Submitters must have authority to advertise, provide accurate information, comply with applicable housing and advertising rules, and follow building restrictions. Do not publish unit numbers or residents’ legal names. Required professional disclosures must be handled through an approved listing format; contact the administrator if those requirements conflict with available fields.
FivePark.co is not acting as your real estate broker, agent, property manager, attorney, lender, or fiduciary merely by hosting a listing or sending an inquiry. We do not negotiate transactions, collect rent or deposits, determine eligibility to occupy a property, or guarantee listing availability, permitted rental periods, property condition, or professional qualifications.
Independently confirm relevant details with the authorized party and appropriate professionals. Sending an inquiry permits delivery to the recipient identified in the form; it does not create an agency relationship with FivePark.co or authorize distribution to unrelated businesses.
9. Advertisements and website fees
Paid placements are identified as advertising or sponsorship. Payment for a listing, advertisement, or other Site service does not confer endorsement, residency approval, priority in moderation, or access to private resident information. Advertisers are responsible for the accuracy, permissions, and terms of their offers.
FivePark.co may charge for its own services, including listings, advertisements, or verification, if the fee and relevant terms are disclosed before purchase. These Site-service fees are separate from payments between buyers and sellers. An external payment provider may process Site-service fees; FivePark.co does not collect payment for classified items.
Before a Site-service purchase, we will disclose the price, duration, scope, applicable taxes, and cancellation or refund terms. We will not enroll you in recurring charges without a separate clear authorization. If we reject paid content before providing the purchased service, we will refund the unprovided service or offer a substitute you accept, subject to any more protective applicable law. Other refund terms must be shown before purchase.
Voluntary contributions support operation of the Site. We do not represent that they are charitable donations or tax-deductible. Contributions do not purchase special treatment or a financial interest in the Site.
10. Events and neighborhood information
Directory entries, articles, event details, and recommendations are provided for general information and may become outdated. Confirm prices, hours, availability, cancellation terms, and event requirements directly with the provider or organizer.
Participation in an event is voluntary and subject to the organizer’s terms and applicable building rules. A Site event listing or RSVP does not reserve an amenity, authorize outside access, or establish approval by building management. Event organizers are responsible for obtaining necessary permissions.
11. External links and listing tools
The Site may link to external websites and services that we do not operate. Their terms and privacy practices govern your use of them. A link does not establish endorsement or affiliation.
Where listing-import or draft-assistance tools are available, use only content you own or may reproduce. Review all imported or generated text and images before publishing. Tools may be unavailable or inaccurate, and importing a listing does not create an ongoing synchronization with its original source. You remain responsible for price, condition, availability, and rights to the material.
12. Site ownership and permitted use
The Site’s original design, software, text, and branding belong to the operator or its licensors, excluding member content and third-party material. You may use the Site for its intended purposes. You may not copy or exploit protected Site material beyond what permission or applicable law allows.
Names and marks belonging to the building, businesses, and other third parties remain their owners’ property. Use of a name on the Site does not grant trademark rights or imply endorsement. To report infringement, identify the material, its location, your rights or authority, and a contact method at jeremy@originalclick.com. Do not submit false claims.
13. Availability and disclaimers
TO THE EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, THE ACCURACY OF THIRD-PARTY CONTENT, OR THE PERFORMANCE OF MEMBERS, ADVERTISERS, SELLERS, AGENTS, OR EVENT ORGANIZERS. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT THOSE DISCLAIMERS ARE LAWFUL.
These provisions do not cancel our express privacy commitments or any warranty, duty, remedy, or consumer right that cannot lawfully be excluded. The Site does not provide professional advice tailored to your circumstances.
14. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM USE OF THE SITE. OUR TOTAL LIABILITY ARISING OUT OF THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR SITE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These exclusions and the cap do not apply to fraud, willful misconduct, gross negligence, or liability that cannot legally be limited. They do not limit any nonwaivable privacy or consumer rights. Some jurisdictions restrict these provisions; in those jurisdictions they apply only to the extent allowed.
15. Responsibility for third party claims
To the extent permitted by law, you agree to reimburse the operator for reasonable losses and legal expenses resulting from a third-party claim caused by your unlawful conduct, knowing violation of these Terms, or submission of content that infringes another person’s rights. This obligation does not cover losses caused by the operator’s own breach, negligence, or misconduct.
We will provide prompt notice of a claim for which we seek reimbursement and reasonable cooperation. No settlement imposing a payment, admission, or continuing obligation on you may be entered on your behalf without your consent, which may not be unreasonably withheld.
16. Ending use and changing the service
You may stop using the Site and request account deletion at any time. We may change or discontinue features or close the Site, with reasonable notice when practical. Any unfulfilled paid Site service will be addressed under its purchase terms and applicable law. Ending access does not erase accrued payment obligations, existing claims, or records lawfully retained under the Privacy Policy.
Provisions that by their nature need to survive termination, including accrued obligations, lawful content retention, liability limits, and dispute provisions, remain in effect to the extent permitted by law.
17. Governing law and disputes
These Terms are governed by Florida law, excluding conflict-of-law rules, except where applicable law requires otherwise. Subject to nonwaivable rights and any court’s jurisdictional requirements, disputes relating to the Site or these Terms will be brought in the state or federal courts located in Miami-Dade County, Florida. Nothing here prevents a claim in a competent small-claims court or a complaint to a regulator.
You may contact us first to seek an informal resolution, but doing so is not a condition to exercising a legal right and does not shorten any applicable filing deadline. These Terms do not impose mandatory arbitration or a class-action waiver.
18. Changes and general provisions
We may revise these Terms by posting a new version with its effective date. We will provide reasonable notice of material changes and request renewed acceptance when required or appropriate. Changes will not retroactively alter an existing dispute or completed purchase. If you do not accept revised Terms, stop using the affected services and contact us about any outstanding paid service.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and expressly accepted service-specific terms describe the agreement for use of the Site. A service-specific term does not override the Privacy Policy’s resident protections through an undisclosed or inconsistent use of personal information.
